Introduction

Chaverim Inc, also known as "Jersey Shore Chaverim," is a volunteer organization that provides roadside assistance and other non-medical emergency help in Deal, NJ, and surrounding areas. We are available 24/6, and our volunteers are trained and experienced in providing assistance. We can help with lockouts, flat tires, battery boosts, gas, directions, and other emergencies. By using our services, you agree to the following terms and conditions.

Disclaimer of Liability

1. No Responsibility for Damage or Loss:

   • Chaverim Inc and its volunteers are not responsible for any damage or loss that may occur to your vehicle, property, or any other belongings during or as a result of our assistance. This includes, but is not limited to, damages resulting from lockout services, tire changes, battery boosts, gas delivery, and any other emergency assistance provided.

2. No Responsibility for Personal Injury or Death:

   • Chaverim Inc and its volunteers are not responsible for any injuries or death that may occur as a result of our assistance. Our members are lay responders and community members, not trained mechanics or emergency medical professionals.

3. Good Samaritan Clause:

   • Our volunteers act as Good Samaritans, providing assistance to those in need to the best of their abilities. By requesting and accepting our help, you acknowledge that our volunteers are not professionally trained mechanics and that the outcome of their assistance is unpredictable.

Release and Indemnification

1. Release of Liability:

   • By using our services, you hereby release and hold harmless Chaverim Inc and the responding volunteer(s) from all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by you or any property belonging to you, whether caused by the negligence of the volunteers or otherwise.

2. Indemnification:

   • You agree to indemnify and hold harmless Chaverim Inc and its volunteers from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, arising out of or related to your use of our services.

General Provisions

1. Voluntary Participation:

   • Your use of our services is voluntary, and you understand that you are not required to accept assistance from Chaverim Inc. You assume all risks associated with accepting our help.

2. No Warranty:

   • Chaverim Inc provides services "as is" without any warranty or guarantee of any kind, express or implied.

3. Governing Law:

   • These terms and conditions shall be governed by and construed in accordance with the laws of the State of New Jersey.

4. Severability:

   • If any provision of these terms and conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these terms and conditions, which will remain in full force and effect.
